How to Challenge a Benefits Decision
Benefits disputes: Universal Credit, PIP, ESA decisions. Mandatory reconsideration and Social Security Tribunal appeals.
If the DWP has refused your benefits claim, reduced your payments, or imposed a sanction you believe is unfair, you can challenge the decision. The first step is a mandatory reconsideration — a formal request for the DWP to review their decision, usually by a different decision-maker.
If the mandatory reconsideration upholds the original decision, you can appeal to the First-tier Tribunal (Social Security and Child Support). Tribunal hearings are free, and you can attend in person or by video. Statistics show that around 70% of PIP appeals are overturned at tribunal.
For service complaints (delays, lost documents, staff conduct), use the DWP's formal complaints process. If unresolved, escalate to the Independent Case Examiner (ICE) and ultimately the Parliamentary Ombudsman.
