Your legal rights

Toys (Safety) Regulations 2011: OPSS confirmed the product does not meet these regulations. Any toy that does not meet safety requirements may not legally be sold.

Consumer Rights Act 2015 s.9: Goods must be of satisfactory quality. A toy contaminated with asbestos categorically fails this test.

Consumer Protection Act 1987 Part I: The manufacturer and importer are strictly liable for damage caused by defective products. You do not need to prove negligence.

You are entitled to a full refund from Asda. No receipt is required for a product safety recall.

If asbestos exposure caused harm or significant distress, you may have a personal injury or compensation claim against the manufacturer. Consider specialist legal advice.

If Asda refuses the refund, you can report them to your local Trading Standards and claim via the County Court.

If your child was exposed

The OPSS notes the sand “may be contaminated with a small quantity of asbestos.” Brief, incidental exposure carries a lower risk than prolonged occupational exposure. However, if your child used this product repeatedly, or if you cut or sanded the sand bottle, consult your GP and mention potential asbestos exposure from a recalled toy. Document the dates and nature of use: this record may matter for any future health claim.
