Remedy
Immediate steps
Stop using the product immediately: remove it from use and keep it away from children
Seal the product in a heavy-duty plastic bag. Do NOT put it in household waste. Asbestos-containing products require specialist disposal
Do not vacuum or disturb asbestos-containing materials: this releases fibres into the air
Return the sealed product to Dunelm for a full refund. No receipt is required for a safety recall under the Consumer Protection Act 1987
If you suspect significant exposure (especially from cutting, sanding, or breaking the product), consult your GP and mention potential asbestos exposure
Report the product to the OPSS at productrecall.campaign.gov.uk or call 020 7215 1000
Contact Trading Standards if Dunelm refuses a refund for a recalled product
Your legal rights
Consumer Rights Act 2015 s.9: Goods must be of satisfactory quality. A product containing asbestos is categorically unsafe and fails this test, regardless of any other characteristics.
Consumer Rights Act 2015 s.10: Goods must be fit for purpose. No consumer product is fit for purpose if it contains asbestos fibres.
Consumer Protection Act 1987 Part I: The manufacturer is strictly liable for damage caused by defective products. You do not need to prove negligence: the defect alone is enough.
General Product Safety Regulations 2005: Producers and distributors must only supply safe products. Breach of these regulations can be a criminal offence.
You are entitled to a full refund, costs of specialist disposal if Dunelm does not arrange collection, and compensation for any consequential loss (GP visits, health monitoring costs).
If exposure causes personal injury or illness, you may have a product liability claim against Dunelm and/or the manufacturer. Consider specialist legal advice.
Long-term health monitoring
Asbestos-related diseases (mesothelioma, asbestosis) have long latency periods: symptoms may not appear for 20–40 years after exposure. If you or a family member were exposed to this product, document the exposure (dates, duration, nature of use) and retain the recall notice. This record may be important for any future health claim.
