Asbestos recall & compensation claims

Exposed to asbestos through a recalled product, building material, or workplace negligence? You have strong legal protections under UK consumer and health & safety law.

Manufacturers face strict liability for asbestos-containing products. Landlords and employers have a legal duty to manage asbestos risk. You don't need to prove fault, just exposure.

Common exposure scenarios

Artex ceilings or textured coatings disturbed during renovation
Asbestos insulation in boilers, pipes, or storage heaters
Recalled building products (e.g. cement sheets, roof tiles, floor tiles)
Workplace exposure in construction, shipbuilding, or manufacturing
Contaminated soil or vermiculite insulation (e.g. Zonolite)
School buildings with unmanaged asbestos
Housing association or council properties with known asbestos risk

Your legal rights

Consumer Protection Act 1987

Strict liability for defective products. A manufacturer is liable for damage caused by asbestos-containing products regardless of fault.

Health & Safety at Work Act 1974

Employers and building owners must protect against asbestos exposure. Failure to manage asbestos risk is a criminal offence.

Control of Asbestos Regulations 2012

Sets the duty to manage asbestos in non-domestic premises. Building owners must identify, assess, and manage asbestos-containing materials.

Limitation Act 1980 (s.11A & s.14)

Asbestos claims have a 3-year limitation from the date of knowledge (when you became aware of exposure), not from the date of exposure itself.

What you can do

1

Check the recall register

Search the OPSS product recall database and the HSE asbestos register to confirm whether your product or material is affected.

2

Document your exposure

Record when and where you were exposed, the product or material involved, and any health symptoms. Photographs, purchase receipts, and medical records strengthen your case.

3

Report to the HSE

The Health and Safety Executive investigates asbestos incidents. Report online at hse.gov.uk or call the HSE helpline. Your report creates an official record.

4

Write a formal complaint

Send a letter to the manufacturer, supplier, or landlord under the Consumer Protection Act 1987. EvenStance generates legally-grounded letters for you.

5

Escalate if ignored

If you get no substantive response, chase in writing and then escalate to Trading Standards, the relevant ombudsman where the trader belongs to a scheme, or consider a County Court claim for damages. No fixed waiting period applies to a product liability claim, so keep a dated record of every chaser.

Urgent: if you think you've been exposed

Asbestos-related diseases (mesothelioma, asbestosis, pleural thickening) can take 15 to 50 years to appear. If you suspect exposure, see your GP immediately and request a chest X-ray. Early medical records are critical evidence for any future claim.
